1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of creatorkit.mashyo.com (the “Site”) and the Creator Kit software applications — including LockSpot, SIVA, SHARA, and MIRAY (each an “App,” collectively the “Apps”) — published by Mashyo (“Mashyo,” “we,” “us,” or “our”). By visiting the Site, downloading an App, or completing a purchase, you agree to these Terms. If you don’t agree, please don’t use the Site or the Apps.

These Terms apply whether you’re a business or an individual consumer purchasing for personal use — except where consumer-protection rights under your local law can’t be waived. Nothing here limits those rights.

2. Who We Are

Mashyo is the developer and publisher of the Creator Kit family of Windows utilities. We’re a small, independently-run software studio — you can read more about our approach on our About page.

3. How You Can Get the Apps

The Apps are distributed through two channels, and different terms apply depending on where you buy:

  • Microsoft Store — if you install or purchase an App through the Microsoft Store, that purchase is governed by Microsoft’s own Store Terms of Use and refund process, not this document.
  • Direct purchase via creatorkit.mashyo.com — if you buy a license directly through this Site, your order is processed by our payment provider, Paddle (Paddle.com Market Ltd and/or its applicable affiliates). Paddle acts as the Merchant of Record for these transactions: Paddle is the authorized reseller of the Apps, and handles billing, invoicing, applicable sales tax/VAT, and payment security. Your purchase is also subject to Paddle’s own Buyer Terms and Checkout Terms. Where anything in Paddle’s terms conflicts with this section on the payment transaction specifically, Paddle’s terms govern that transaction.

4. License, Not Sale

Purchasing an App gives you a personal, non-exclusive, non-transferable, revocable license to install and use that App on devices you own or control, for your own personal or internal business use. You are not buying the software outright — this license doesn’t transfer any ownership, copyright, trademark, or other intellectual property rights to you. All rights not expressly granted are reserved by Mashyo.

You agree not to:

  • Reverse-engineer, decompile, or disassemble any App, except where local law expressly permits it despite this restriction
  • Resell, sublicense, rent, or redistribute an App or any license key
  • Circumvent licensing, trial limits, or activation mechanisms
  • Use an App to build a directly competing product

5. Free Trials

Where an App offers a free trial (e.g. SHARA’s 7-day trial), it’s provided “as is” to let you evaluate the software before paying. We may change or end trial availability, duration, or included features at any time without notice.

6. Pricing & Payment

Prices shown on the Site are displayed in the currency Paddle detects for your location, and may include or exclude tax depending on where you’re buying from — Paddle calculates and handles any tax owed on Paddle-processed transactions. We may change prices at any time; a change won’t affect a license you’ve already purchased.

7. Refunds

Refunds for purchases made through this Site are handled according to our Refund Policy, which forms part of these Terms. Refunds for Microsoft Store purchases follow Microsoft’s own refund process instead.

8. Software Updates & Changes

We actively develop the Apps and may release updates, patches, or new versions. We may also change, deprecate, or remove features over time as the Apps evolve. We don’t guarantee that any specific feature will remain available indefinitely, or that the Apps will stay compatible with every future version of Windows — though we make a good-faith effort to keep things working well.

9. Acceptable Use

You agree to use the Site and Apps only for lawful purposes, and not in any way that could damage, disable, or impair our systems, or interfere with anyone else’s use of them.

10. Intellectual Property

The Site, the Apps, and all related branding, text, graphics, logos, and code are owned by Mashyo or our licensors, and are protected by copyright, trademark, and other intellectual property laws. Nothing on the Site or in these Terms grants you any right to use the “Mashyo,” “Creator Kit,” “SIVA,” “SHARA,” or “MIRAY” names or logos without our prior written permission.

11. Disclaimer of Warranties

The Site and Apps are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory — including, to the fullest extent permitted by law, any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We don’t warrant that the Apps will be uninterrupted, error-free, or entirely secure, or that any defects will be corrected. Nothing in this section limits any warranty that cannot legally be excluded in your jurisdiction.

12. Limitation of Liability

To the fullest extent permitted by law, Mashyo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of — or inability to use — the Site or Apps, even if we’ve been advised of the possibility of such damages. Where liability can’t be fully excluded, our total liability for any claim relating to an App will not exceed the amount you actually paid for that App in the 12 months before the claim arose. This limitation doesn’t apply to liability that can’t be limited under applicable law (for example, liability for gross negligence, fraud, or death or personal injury we’ve caused).

13. Third-Party Services

The Site and Apps may rely on or link to third-party services — including Paddle for payments, Microsoft for distribution and OS-level APIs, and standard web analytics on the Site itself. We aren’t responsible for the practices, content, or availability of third-party services; their own terms and privacy policies apply.

14. Termination

We may suspend or terminate your license if you materially breach these Terms — for example, by circumventing licensing or reselling a key. You may stop using an App and uninstall it at any time.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Apps, our business, or legal requirements. We’ll update the “Last updated” date above whenever we do. Continuing to use the Site or Apps after changes take effect means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of Türkiye, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws in your own country give you additional rights that can’t be overridden.
